TERMS AND CONDITIONS OF USE

1. INTRODUCTION
These Terms and Conditions (“Terms”) govern access to and use of the Pulse Hub
Platform (“Platform”), owned and operated by TPN Organization (“TPN”, “we”, “our”, or
“us”).
By accessing, registering, or using the Pulse Hub Platform, you (“User”, “you”, or “your”)
agree to comply with and be legally bound by these Terms and Conditions, together with
all applicable policies, guidelines, and notices referenced herein.
If you do not agree with these Terms, you must not access or use the Platform.
2. ABOUT PEAICH PLATFORM
PEAICH is a digital platform operated by TPN Organization designed to facilitate
communication, service delivery, data management, user engagement, reporting,
operational coordination, and related digital services.
The Platform may provide access to:
• User accounts and dashboards
• Communication and collaboration tools
• Reporting and analytics features
• Subscription-based services
• Notifications and information services
• Data management and document handling systems
• APIs and integrations with authorized systems
TPN reserves the right to modify, suspend, or discontinue any part of the Platform at any
time.
3. ELIGIBILITY
To use the Platform, you must:
• Be at least eighteen (18) years of age or have legal authority to enter into binding
agreements;
• Provide accurate and complete registration information;
• Use the Platform in compliance with Tanzanian laws and regulations;
• Not be prohibited from using digital services under applicable law.
TPN reserves the right to deny or terminate access where eligibility requirements are not
met.
4. USER ACCOUNT REGISTRATION
4.1 Account Creation
Users may be required to create an account to access certain features of the Platform.
You agree to:
• Provide accurate and current information;
• Maintain the confidentiality of login credentials;
• Accept responsibility for activities conducted under your account;
• Notify TPN immediately of unauthorized access or security breaches.
4.2 Account Security
Users are responsible for:
• Protecting passwords and authentication credentials;
• Logging out after each session where necessary;
• Ensuring devices used to access the Platform are secure.
TPN shall not be liable for losses arising from unauthorized account use caused by user
negligence.
5. ACCEPTABLE USE OF THE PLATFORM
Users agree to use the Platform lawfully, responsibly, and ethically.
You shall NOT:
• Violate any applicable law or regulation;
• Upload malicious software, viruses, or harmful code;
• Attempt unauthorized access to systems or data;
• Interfere with Platform operations or security;
• Use the Platform for fraudulent or deceptive activities;
• Harass, abuse, threaten, or impersonate others;
• Upload unlawful, defamatory, obscene, or offensive content;
• Conduct unauthorized data scraping, mining, or extraction;
• Use the Platform to distribute spam or unsolicited communications;
• Circumvent security mechanisms or access controls.
TPN reserves the right to investigate violations and take appropriate action.
6. DATA PRIVACY AND PROTECTION
TPN Organization is committed to protecting personal data in accordance with:
• The Personal Data Protection Act, 2022 (Tanzania);
• TCRA regulations;
• Applicable cybersecurity and privacy laws.
By using the Platform, users consent to:
• Collection and processing of data necessary for service delivery;
• Security monitoring and logging activities;
• Use of information in accordance with the Pulse Hub Security and Data Protection
Policy.
Users retain rights over their personal data as provided under Tanzanian law.
7. USER CONTENT
7.1 Ownership of Content
Users retain ownership of content they submit to the Platform.
However, by uploading or submitting content, users grant TPN a non-exclusive, limited
license to:
• Store,
• Process,
• Display,
• Transmit, and
• Use such content solely for Platform operations and service delivery.
7.2 Responsibility for Content
Users are solely responsible for content uploaded or shared through the Platform.
Users warrant that submitted content:
• Does not violate any law;
• Does not infringe intellectual property rights;
• Does not contain malicious or harmful material.
TPN reserves the right to remove content that violates these Terms or applicable laws.
8. INTELLECTUAL PROPERTY RIGHTS
All Platform materials including:
• Software,
• Logos,
• Branding,
• Graphics,
• Databases,
• Content,
• System architecture,
• Documentation, and
• Source code
remain the exclusive property of TPN Organization or its licensors.
Users shall not:
• Copy,
• Modify,
• Reverse engineer,
• Reproduce,
• Redistribute, or
• Commercially exploit any Platform materials without prior written authorization.
9. PLATFORM AVAILABILITY
TPN aims to maintain continuous Platform availability but does not guarantee
uninterrupted service.
The Platform may be temporarily unavailable due to:
• Maintenance,
• System upgrades,
• Security incidents,
• Technical failures,
• Internet disruptions,
• Force majeure events.
TPN shall not be liable for interruptions beyond reasonable control.
10. SECURITY MONITORING
To protect users and infrastructure, TPN may:
• Monitor system activity,
• Log user access,
• Conduct security audits,
• Investigate suspicious behavior,
• Block malicious activity.
Unauthorized access attempts may result in:
• Immediate suspension,
• Reporting to authorities,
• Legal action under Tanzanian law.
11. THIRD-PARTY SERVICES
The Platform may integrate with third-party systems or services.
TPN is not responsible for:
• Third-party content,
• External websites,
• Independent privacy practices,
• Third-party service failures.
Users accessing third-party services do so at their own risk.
12. SUBSCRIPTIONS, PAYMENTS, AND FEES
Where applicable:
• Certain services may require payment or subscription;
• Fees shall be communicated clearly before purchase;
• Users agree to provide accurate billing information.
TPN reserves the right to:
• Modify pricing structures;
• Suspend services for unpaid accounts;
• Introduce new paid services.
Unless otherwise stated, payments are non-refundable.
13. TERMINATION AND SUSPENSION
TPN may suspend or terminate access immediately where:
• Users violate these Terms;
• Fraudulent or illegal activities are detected;
• Security risks arise;
• Regulatory obligations require action.
Users may also terminate their accounts subject to applicable obligations and data
retention requirements.
Termination does not waive accrued legal rights or liabilities.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law, TPN Organization shall not be liable for:
• Indirect or consequential damages;
• Data loss;
• Loss of profits or business;
• Service interruptions;
• Unauthorized access caused by user negligence;
• Cyberattacks beyond reasonable control.
Use of the Platform is at the user’s own risk.
15. INDEMNIFICATION
Users agree to indemnify and hold harmless TPN Organization, its employees, officers,
affiliates, and partners against claims, damages, liabilities, or expenses arising from:
• Violation of these Terms;
• Misuse of the Platform;
• Infringement of third-party rights;
• Unlawful conduct.
16. COMPLIANCE WITH LAWS
Users agree to comply with:
• Tanzanian laws and regulations;
• TCRA directives;
• Cybersecurity laws;
• Intellectual property laws;
• Data protection obligations;
• Electronic communications regulations.
Any unlawful use of the Platform is strictly prohibited.
17. RECORDS AND ELECTRONIC COMMUNICATIONS
Users agree that:
• Electronic communications satisfy legal communication requirements;
• Digital records and logs maintained by TPN may serve as evidence where legally
permissible;
• Notifications may be delivered electronically.
18. FORCE MAJEURE
TPN shall not be liable for delays or failures caused by events beyond reasonable control,
including:
• Natural disasters,
• Power outages,
• Cyberattacks,
• Government actions,
• Telecommunications failures,
• Civil unrest,
• Pandemic events.
19. CHANGES TO TERMS
TPN reserves the right to update these Terms at any time.
Updated Terms shall:
• Be published on the Platform;
• Take effect upon publication unless otherwise stated. Continued use of the
Platform constitutes acceptance of revised Terms.
20. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and interpreted in accordance with the laws of the
United Republic of Tanzania.
Any disputes arising from these Terms shall be subject to the jurisdiction of Tanzanian
courts and competent regulatory authorities.
21. ACCEPTANCE OF TERMS
By accessing or using the Pulse Hub Platform, users confirm that they:
• Have read and understood these Terms;
• Agree to comply with them;
• Consent to all applicable policies governing the Platform.
